News for all Andorran companies regarding gender equality in force this year
On November 22, 2023, the Government approved the regulations of the two registries that the Law on Gender Equality has promoted: the wage gap registry and the equality plans registry.
Failure to comply with these obligations regarding equality will be considered a serious infraction with penalties between 501 and 3,000 euros.
Within the scope of the measures adopted by the Government of Andorra to promote gender equality, in 2024 new obligations will be incorporated to be met by Andorran companies. Among others, the record of the wage gap, which affects all companies in the country, regardless of the number of workers.
These will have to provide information on salary indicators linked to gender, indicating the difference between the average annual global remuneration of women and men, calculated on a full-time basis, by age group and professional group, according to the professional classification applicable to the company. as well as by the category of equivalent jobs or jobs of equal value.
These data, corresponding to the previous year, must be sent to the registry managed by the Department of Occupation and Labor before March 31, although, exceptionally, this year 2024 the deadline is extended to June 30.
On the other hand, companies with 50 or more workers are obliged to implement their own equality plan, while those with a smaller workforce may do so voluntarily. These plans must reflect actions aimed at promoting gender equality, adjusting to the specific characteristics of each company.
They are required to include, at a minimum, awareness-raising and training initiatives for staff, measures to prevent sexual and gender-based harassment, and specific procedures in people management processes. Registration has a deadline of October 1. Even so, and exceptionally, the corresponding equality plans in 2023 may be registered between May 1, 2024 and October 1, 2024.
Failure to comply with these equality obligations will be considered a serious infraction, and may incur penalties ranging between 501 and 3,000 euros.
